Queensland Pool Safety Inspections

New QLD Swimming Pool laws have been introduced from 1 December 2010.

IMPORTANT : All pools and spas need to be compliant by November 2015. This means all pool owners need to have a compliant pool fence around their pool/spa. Not sure where to start ring me I will be happy to help!

ALL swimming pools in Queensland needs to be registered before the 4th November 2011 - fines of $2000 will apply.

To register your pool go to: www.hpw.qld.gov.au/poolsafety then go to "Register your pool"

(Please check this even if you have had your final inspection through council!) If in doubt - just ring and I will be happy to assist you.

A guide to make sure you are doing the right thing includes:

Buying, selling or leasing a property with a pool needs a pool safety certificate, issued by a licensed pool safety inspector.

  • These laws apply to houses, units, hotels, motels, backpacker hostels, caravan parks, mobile van parks and other forms of short-term accommodation.
  • All swimming pools need to be included on the state-based pool safety register by 4 May 2011.
  • All portable pools and spas also need to have a compliant safety barrier.

When selling your property with a non-shared pool after 1 Dec. 2010 you have 2 options: - have a pool safety certificate before settlement of contract, or the seller may give the buyer a form 36 which advises the buyer that a certificate must be obtained within 90 days of settlement.

When leasing a property, a pool safety certificate must be obtained by the owner/landlord before entering into a lease.

For properties with a shared pool associated with short-term accommodation, such as hotels, motels, backpackers or hostels, have till 31 May 2011 to have their pools compliant and obtain a Pool Safety Certificate.

New pools require building development approval. - This includes a Pool Safety Certificate.

These pool safety certificates are valid for 2 years if it is a non-shared pool and 1 year for a shared pool.
